Terms of Service
Peak Streak · Effective from 12 July 2026
These Terms govern the Peak Streak mobile app, account and online service operated by Marcin Tobała Digital Media, Służba Polsce 4/18, 32-200 Miechów, Poland, VAT/NIP: PL6591489319 (“we”, “us”). By creating an account or otherwise using the service, you agree to these Terms.
Our Privacy Policy explains how we process personal data. It is a notice, not an agreement or consent to optional processing. Where we rely on consent, we ask separately and you may refuse or withdraw it without losing access to features that do not require that processing.
1. The service
Peak Streak is a general fitness, habit and wellness challenge service. Depending on the release and your choices, you can make a commitment, log actions, review progress, follow a curated Journey, join an event and participate with Friends or a private Crew. The service includes on-device guest features and optional account, social and Premium features.
The feature descriptions, purchase screen and applicable store listing form part of the information about the service. We do not promise a feature marked as unavailable, disabled or coming later.
2. Age and legal capacity
You must be at least 16 years old. If you are 16 or 17, applicable law may still treat you as a child or limit your ability to enter a paid contract. You may purchase Premium only through a store account you are authorised to use and with parent or guardian authorisation where applicable law requires it. Do not create an account if you are under 16.
3. Accounts and guest use
- You may use supported guest features without an account. Guest progress is saved on the device and may be lost if the app or its data is removed.
- An account is required for cloud backup, Friends, Crew and other connected features. You must provide accurate information and keep credentials and verification codes secure.
- You may sign in with email and password or a supported Apple or Google method. You remain responsible for keeping the corresponding provider account secure.
- Do not transfer, sell, share or use another person's account. Notify support promptly if you believe your account has been compromised.
4. Premium purchases and subscriptions
Peak Streak has free functionality and may offer Premium through auto-renewing subscriptions and, if displayed, a separate one-time purchase. Only the products shown on the final Apple App Store or Google Play purchase screen are available.
- Before you confirm a purchase, the store screen identifies the product, total price, applicable billing period, renewal frequency, minimum commitment, any trial or introductory period, the first paid charge and how to cancel. That information forms part of the purchase.
- An auto-renewing subscription renews for the period and price shown by the billing store unless you cancel before its displayed renewal deadline. Cancellation stops future renewals. Access normally continues until the end of the period already paid for, unless the store or applicable law provides otherwise.
- A free or discounted trial converts to the paid subscription and price shown before purchase unless you cancel before the displayed trial deadline.
- If a subscription price changes, the store provides notice and obtains any consent required by law. You may cancel before the new price takes effect.
- A one-time Premium purchase, if offered, is not an auto-renewing subscription. It unlocks the features identified on its purchase screen for the supported lifetime of the service; it does not promise that every future product or separately priced service will be included.
- Use Restore purchases to restore an eligible entitlement. Deleting a Peak Streak account or uninstalling the app does not cancel a store subscription.
5. Cancellation, withdrawal, refunds and statutory remedies
Start subscription management, cancellation or a voluntary refund request through the store that billed you. Contact us if the store directs you to the developer or you need help with a mandatory consumer right. A store's voluntary refund policy is additional to, and does not replace, any statutory cancellation, withdrawal, conformity, price-reduction, termination or refund right.

Consumers in the EEA ordinarily have 14 days from a distance contract to exercise a right of withdrawal, subject to the rules for digital services and digital content. UK consumers may have a cancellation right under the Consumer Contracts Regulations. The billing store may provide the mechanism for exercising that right and may record a request for immediate supply where the law permits. To exercise a right directly against us, email support with the subject Withdrawal or consumer claim.
We will provide the service with reasonable care and skill and in conformity with the contract and applicable consumer law. If it is not supplied or is not in conformity, you may be entitled to have it brought into conformity, receive a proportionate price reduction, terminate the contract or receive a refund. Nothing in these Terms limits a right that cannot lawfully be limited.
6. Health, safety and medical-device disclaimer
Peak Streak offers general fitness, habit and wellness information and self-tracking tools. It is not a medical device and does not diagnose, treat, cure or prevent any medical condition. It does not provide medical advice, emergency monitoring or a substitute for professional care. Streaks, scores, coaching copy and community activity are motivational features, not clinical conclusions.
Consult a qualified healthcare professional for medical advice, diagnosis or treatment and before starting or changing an exercise, hydration, diet, sleep or wellness routine, especially if you are pregnant, have a medical condition, take medication or have been advised to restrict exercise or fluids. Choose an appropriate goal, use safe technique and stop if you feel pain, dizziness, shortness of breath or otherwise unwell. In an emergency, contact local emergency services.
You control the actions you take. Do not use a streak, Crew result or challenge target as a reason to ignore pain, medical advice, fluid restrictions, weather, equipment limits or another safety concern.
7. Community rules
Names, profile photos, invitations, Crew Feed notes, reactions, reports and other submissions must comply with the Community Guidelines, which are incorporated into these Terms. Before creating Crew content, you must accept both the current Terms and the current Community Guidelines presented in the app.
You must not use the service to:
- harass, bully, stalk, threaten, dox, intimidate or exploit another person;
- promote hatred, discrimination, violence, self-harm or a dangerous act;
- submit sexual exploitation, child sexual abuse or exploitation, non-consensual intimate content, pornography or sexualised content involving a minor;
- impersonate, defraud, scam, phish, spam or repeatedly send unwanted invitations;
- infringe privacy, intellectual-property or other legal rights;
- post links, malware, commercial solicitation or instructions to bypass safeguards; or
- probe security, scrape private information, overload the service, automate unauthorised activity or access another person's account.
We have zero tolerance for child sexual abuse and exploitation. Do not send suspected illegal imagery to support. Use the in-app report with identifying context and contact the appropriate authority or specialist hotline where urgent.
8. Reporting, blocking, moderation and appeals
Use the in-app Report, Block and mute controls. Reporting can hide an item for you immediately while an authorised moderator reviews it. Depending on the context, we may remove content, restrict invitations or social features, remove a person from a Crew, suspend or terminate an account, preserve evidence or notify authorities. Serious safety, security or legal risks may require action without advance notice.
Where required, we explain a moderation restriction and provide a way to request review. Email support with the subject Moderation appeal and enough context to identify the decision. For a remediable minor breach, we normally provide notice and a reasonable opportunity to correct it. Retaliation against a reporter is prohibited.
9. Your content and licence
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, transmit, display to the audience you selected, back up, technically adapt and moderate that content only as necessary to provide, secure and lawfully operate the service. This licence does not permit us to sell private content, use it for targeted advertising or use it to train an external generative-AI model.
The licence ends when the content is deleted from active systems, subject to the verified backup schedule and a specific lawful retention requirement. Other Crew members may keep screenshots or copies outside our control. You are responsible for having the necessary rights and permissions, including for a photo of another person. Do not submit confidential medical records or content you do not want the selected audience to know.
10. Invitations and social participation
Send invitations only to people who reasonably expect to hear from you. Crew participation is voluntary and separate from a Friend relationship. Each participant remains responsible for their own commitment and safety. Team status, streaks, Shields, XP and cosmetic rewards have no cash value and must not be used for gambling or wagering.
11. Our intellectual property and app licence
The service, Peak Streak name and logo, software, design, mascot and first-party content are owned by us or our licensors and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes in accordance with these Terms and the applicable store licence.
12. Privacy
The Privacy Policy explains processing of account, fitness and wellness data; profile photos; Friends and Crew activity; user content; reports; push tokens; diagnostics; purchases; optional consent-based product analytics; and separately optional consent-based marketing attribution.
13. Apple, Google and other third-party services
Apple, Google, Supabase, RevenueCat, Sentry, PostHog, AppsFlyer, Resend and Vercel provide parts of the service. Their terms apply to the services they control. AppsFlyer provides optional mobile campaign attribution only after a separate Peak Streak opt-in. On iOS, Apple App Tracking Transparency authorisation is also required before AppsFlyer or its RevenueCat attribution bridge starts. Denial or restriction leaves them off and does not limit another feature. This measurement is disclosed as tracking in App Store privacy details for consenting iOS users, but it is not used for advertising personalisation. We remain responsible for our own obligations and do not exclude rights merely because a provider is involved.
For iOS users, Apple's Standard End User License Agreement governs the licence to the iOS app. These Terms separately govern the Peak Streak account and online service. Google Play terms apply to the Android store and billing relationship.
14. Availability, updates and service changes
We use reasonable care to keep the service available but do not promise uninterrupted operation or compatibility with every device. Activity saved offline may wait for a later connection. Security, legal, compatibility and maintenance updates may be required to continue using connected features.
We may modify the service only for a valid reason, including compliance with law, security, prevention of abuse, technical compatibility or a necessary operational change. A modification will not impose an additional charge without your agreement. We explain a material change and provide reasonable advance notice on a durable medium where required.
If a modification negatively affects access to or use of a paid digital service by more than a minor degree, you may have the right to terminate without charge and receive any refund required by law. A change does not apply retroactively. Where law requires agreement, silence is not treated as acceptance.
15. Responsibility and liability
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for business losses suffered by a person using the service for personal purposes, or for loss caused solely by unsafe use, inaccurate information you provide or a third-party system outside our reasonable control.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct or gross negligence where applicable, mandatory digital-content or service rights, unlawful personal-data processing, or any other liability or remedy that cannot lawfully be excluded or limited.
16. Suspension, termination and account deletion
You may stop using the service or delete your account through You → Settings → Delete account & data. See the account deletion instructions. Account deletion is separate from cancellation of a store subscription.
We may immediately restrict access where reasonably necessary for a serious safety, security or legal risk. We may restrict or terminate access for a material or repeated breach, unlawful activity or a threat to the service. Where legally possible, we explain the action and provide a review route. If we discontinue or terminate paid access for a reason that is not your fault, we provide the proportionate refund or other remedy required by law, normally through the store that processed the purchase.
17. Changes to these Terms
We may update these Terms for a valid legal, security, safety, compatibility or service reason. We publish the new effective date and give advance notice of a material change where required. A material change does not apply retroactively. If law requires agreement, we ask for it. If you do not accept a change that requires acceptance, you may stop using the service and delete the account before it takes effect, without losing any mandatory remedy.
18. Governing law and disputes
These Terms are governed by the laws of Poland, without depriving a consumer of mandatory protections of the country where they habitually live. Contact support first if you want us to investigate a complaint. This does not restrict a consumer's right to use a competent court, regulator or available statutory dispute-resolution process.
